State releases SB 423 streamlining update

SB 423 requires that jursidictions that have not made sufficient progress on their housing goals are subject to Streamlined Ministerial Approval Process (SMAP).for qualifying proposed developments. The California Department of Housing and Community Development (HCD) evaluates all jurisdictions half-way through each housing element cycle and at the end of each housing element cycle. HCD completed the determination for the 2nd half of the 5th housing element cycle in June 2023. Here is how Marin’s jursidictions fared:

These jurisdictions are subject to SB 423 SMAP for proposed developments with at least 10% affordability or the 20% moderate income.

• Belvedere, San Rafael, Sausalito: These jurisdictions have insufficient progress toward their Above Moderate income RHNA OR Above Moderate and Lower Income RHNA.
• Larkspur: Larkspur does not have a certified houwing element.

These jurisdictions are subject to SB 423 SMAP for proposed developments with at least 50% affordability. They have insufficient progress toward their Lower income RHNA (Very-Low and Low income).

• Novato, San Anselmo, Tiburon

These jurisdictions are not subject to streamlining.

• Corte Madera, Mill Valley, Marin County, Ross
