Support for Mallard Pointe at 1/22 Belvedere City Council Meeting

Belvedere City Council will consider an appeal of the Planning Commission’s November 14, 2023 decision to require a full environmental review document and process for this needed infill housing project, even though it had been determined by City staff and a team of professional consultants that the project is eligible for an exemption from this review under the California Environmental Quality Act (CEQA) Guidelines. The City Council will consider the eligibility of the CEQA exemption. Support of this appeal and this CEQA exemption is critical in order to expedite this needed housing project through the approval process and construction. MEHC supports the appeal, this project, and encourages City Council members to vote in approval of the appeal.

Talking Points 

  • The project clearly meets the standard for the infill exemption — other single family developments around the lagoon are historically considered exempt.
  • The lagoon is not a significant resource – it is dredged, treated with chemicals, and dyed blue.
  • The developer has submitted a 70-unit Builder’s Remedy proposal in the event that the appeal is denied and a full EIR has to be completed. This Builder’s Remedy proposal cannot be denied legally.
